Eighth Circuit Court of Appeals denies petition for rehearing on March 15,
2007, No. 05-4005.
Eighth Circuit Court of Appeals affirms lower court’s denial of habeas
relief in Ringo v. Roper, 472 F.3d 1001 (8th Cir. 2007)
(January 4, 2007).
Denial of 59(e) Motion to alter judgment following denial of federal
habeas by the U.S. District Court for the Western District of Missouri, Case
No. 03-cv-0800 (before Dorr, J.).
- Denial of federal habeas. Ringo v. Roper, 2005 WL 2017439 (W.D.Mo.
2005).
- Denial of post-conviction relief affirmed by Ringo v. State, 120
S.W.3d 743 (Mo. banc 2003).
- Conviction and sentence affirmed on direct appeal by State v.
Ringo, 30 S.W.3d 811 (Mo. banc 2000), cert. denied, 121 S. Ct.
1381 (2001).
SIGNIFICANT LEGAL ISSUES:
- Batson claim regarding exclusion of African-American
veniremember who stated, among other things, objections to sitting
in judgment of another.
- Discoverability of names and addresses of grand jurors or master
lists in order to make claim of race or gender-based systematic
exclusion from jury service
- failure of trial counsel to investigate and present evidence
that Mr. Ringo suffers from post-traumatic stress disorder
- Ineffectiveness of counsel for stipulating to changed venue in
Cape Girardeau County, Missouri, which had history of under representing
African-Americans in petit juries (only four African-Americans out of 163 venirepersons in this case). Mr. Ringo was tried by an all white jury.
